Ref : Jamboni PS Case No. 29/97 Dt. 12.03.97 U/S- 302/34 IPC. “The Convict has been produced before the Ld ADJ FT 2nd Court , Paschim Medinipur , Smt Rajashri Basu Adhikari , and, Ld. P.P. in-charge and Ld. Lawyer for the accused were present . I have heard the convict personally and his Ld. Lawyer in respect of the sentenced, which may be imposed upon him for the offence punishable u/s- 302 IPC. I have heard the submission of the Ld. P.P in-charge in this regard. The convict claimed, he was falsely implicated in this case and also prayed for mercy and lesser punishment as for as possible. I have considered the prayer of the convict and the lesser sentence vis a vis the offence committed by him, the offence punishable u/s- 302 IPC is punishable with death and or life imprisonment and find, there is no other opinion before the court in this regard. In view with the facts and circumstances of the case, I am of clear opinion that, this is a case where the murder by the convict, so, I have no other alternative but to sentence the convict Chhoto Hango for life imprisonment along with a fine a Rs- 5000/- in default to J/c for 6 months. The period for which the convict was in custody shall be set off against the sentence for imprisonment. Issue custody W/A wherein according to the sentence passed above, the alamats seized in connection of this case may be disposed of after the appeal period. Accused Chaitan Murmu is found not guilty of committing offence u/s- 302/34 IPC and he is hereby acquitted u/s- 235 Cr.P.C. Let the accused person be set at liberty at once. Surety to be released from bail bond. Let a copy of Judgment be supplied to the convict at once free of cost. on 22.12.14
